GENERAL TERMS AND CONDITIONS

I. SUBJECT
Art. 1. These General Terms and Conditions govern the relationship between I-Kom 24 Ltd., hereinafter referred to as the “Seller” or “Provider,” and individuals, hereinafter referred to as “User,” “Customer,” or “Consumer,” who use the NOA Pilates online store, accessible at www.noapilates.com, for the purchase of goods offered therein.
Art. 2. By using the online store, including placing an order, the User declares that they have read, understood, and accepted these General Terms and Conditions.

III. FEATURES OF THE ONLINE STORE
Art. 5. The online store is an e-commerce platform through which Users can:

Art. 6. All product images are for illustrative purposes only; minor differences in color or appearance due to device screens or production specifics may occur, without affecting essential product characteristics.
Art. 7. The Seller makes reasonable efforts to ensure information is accurate and up to date but does not guarantee absence of technical errors, temporary discrepancies, stock depletion, or obvious mistakes in prices and descriptions.
IV. REGISTRATION AND USE OF THE STORE
Art. 8. Users may use the store with or without registration, unless registration is required for specific functionality.

Art. 10. The Seller is not responsible for delays, inability to deliver, or other adverse outcomes caused by incorrect, incomplete, or inaccurate data provided by the User.
Art. 11. The Seller reserves the right to refuse processing or fulfilling an order if there is reasonable suspicion of fraud, abuse, technical error, obviously incorrect price, lack of stock, or violation of these Terms.
V. CONTRACT FORMATION
Art. 12. A sales contract between the Seller and the User is concluded when the Seller confirms the order via email, phone, or another durable medium.

Art. 14. Before finalizing, Users may review and correct any errors in the entered data.
Art. 15. The contract is concluded in Bulgarian. The Seller stores order information as necessary for contract execution and legal compliance.
VI. PRICES AND PAYMENT
Art. 16. All prices are in Bulgarian lev (BGN), unless otherwise stated, and include applicable taxes unless stated otherwise.
Art. 17. Delivery costs not included in the product price are displayed separately before finalizing the order.

Art. 19. Card payments are processed by the payment provider in a secure environment; the Seller does not store full card details.
Art. 20. Cash on delivery payments are made to the courier upon delivery per the courier service terms.
Art. 21. In the event of an obvious technical pricing error, the Seller may refuse the order, notifying the User within a reasonable time.
VII. DELIVERY
Art. 22. Delivery is within Bulgaria, unless otherwise specified.
Art. 23. Delivery times are indicative and may vary depending on location, courier workload, public holidays, and other objective circumstances.
Art. 24. The Seller is not responsible for delays caused by the courier, force majeure, adverse weather, inaccurate delivery information, or other factors beyond reasonable control.
Art. 25. Upon receipt, the User should inspect the visible condition of packaging and goods and notify the courier and Seller of any visible damage immediately.
VIII. RIGHT OF WITHDRAWAL
Art. 26. Users may withdraw from the contract within 14 days without giving a reason, starting from the date they or a third party designated by them (other than the carrier) received the goods. Standard distance sales rules and exceptions apply.
Art. 27. To exercise this right, Users must notify the Seller via unequivocal statement by email, mail, or the standard withdrawal form attached to these Terms.
Art. 28. Upon withdrawal, the Seller refunds all payments, including standard delivery costs, without undue delay and no later than 14 days from notification. Refunds may be postponed until the goods are returned or proof of return is provided.
Art. 29. Users must return the goods without undue delay and no later than 14 days from notification. The deadline is met if the goods are sent before the 14-day period expires.
Art. 30. Unless otherwise indicated, return costs are borne by the User.
Art. 31. Users are responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functionality of the goods.
Art. 32. The right of withdrawal does not apply to cases provided by law, including sealed goods unsealed after delivery for hygiene or health protection reasons, and other exceptions under Art. 57 of the Consumer Protection Act.
IX. COMPLAINTS AND LEGAL WARRANTY
Art. 33. Users may submit complaints regarding nonconformity of received goods with the sales contract according to applicable law.

X. RIGHTS AND OBLIGATIONS OF THE PARTIES

XII. INTELLECTUAL PROPERTY
Art. 42. All texts, images, logos, trade marks, graphics, design, and other content are protected by law and may not be used without prior written consent, except where explicitly permitted by law.
XIII. LIMITATION OF LIABILITY
Art. 43. The Seller is not liable for damages resulting from:

Actions or inactions of third parties, including couriers, payment operators, and external service providers

Temporary website unavailability due to maintenance, force majeure, or other objective reasons
Art. 44. Nothing in these Terms limits or excludes consumer rights that cannot be limited or excluded by law.
XIV. CHANGES TO TERMS
Art. 45. The Seller may amend these Terms by publishing the current version on the website.
Art. 46. Changes apply to future orders after publication unless otherwise required by law.
XV. TERMINATION AND DISPUTES
Art. 47. The contract is terminated upon fulfillment, unless otherwise stated by law or these Terms.
Art. 48. Bulgarian law applies to unresolved matters.
Art. 49. Disputes are resolved by mutual agreement, or failing that, by competent Bulgarian courts or consumer protection authorities.
XVI. FINAL PROVISIONS
Art. 50. These Terms enter into force on 17.03.2026.

RELATIONSHIP WITH SHOPIFY
NOA Pilates is powered by Shopify to provide services. All sales and purchases are directly with NOA Pilates. By using the services, you agree that Shopify is not liable for any aspect of sales between you and NOA Pilates and expressly release Shopify and affiliates from any claims, damages, or liabilities related to your transactions.

Appendix 2 – Information on the Right of Withdrawal
You have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day you or a third party designated by you (other than the carrier) received the goods.
To exercise this right, notify us with an unequivocal statement via email or mail. You may use the standard withdrawal form, but it is not mandatory.
Upon withdrawal, we will refund all payments received, including standard delivery costs, without undue delay and no later than 14 days from notification. Refunds may be postponed until receipt of goods or proof of shipment.
Return the goods without undue delay and no later than 14 days from notification. The deadline is met if you send the goods before the 14-day period expires.
Return costs are borne by the User unless otherwise stated by the Seller.
